Policies and FAQ for Empire State Munitions
New York Residents
We are open to the public for appointments. Call or email us during business hours to set up a time and date.
All consignment firearms are available for purchase at our store, provided you complete the necessary paperwork. Consignment firearms may include models not typically available due to New York's strict regulations, such as certain handguns and rifles. All long guns sold are 100% compliant with New York state laws, including the NY SAFE Act, with compliant accessories and magazines (10-round capacity or less).
To purchase a firearm, you must provide:
- A valid New York Pistol License (for handguns), a valid ID (for long guns), A valid semi auto rifle license (for semi auto rifles).
- A background check via the National Instant Criminal Background Check System (NICS) at the time of purchase.
If you do not have a New York Pistol License for handgun purchases, you must obtain one from your county of residence before purchasing. We can guide you through the process if needed.
Non-consignment firearms can be shipped to a New York-licensed Federal Firearms Licensee (FFL) of your choice. Please confirm with your FFL that they accept transfers from Empire State Munitions. We will coordinate with them to provide the necessary paperwork.
We accept inbound firearm transfers to our store for a fee. Contact us to confirm if we can order a specific firearm. All firearms must comply with New York state laws, including the NY SAFE Act. Handguns and long guns must be compliant with state regulations.
At this time, we do not accept ammunition transfers. Contact us for ammunition availability and pricing. All ammunition sales comply with New York’s requirement that purchases be made through a licensed dealer, with background checks for all ammo purchases.

Out-of-State Customers
All items on our website can be shipped to out-of-state customers, subject to federal, state, and local laws. Please familiarize yourself with your local regulations before ordering.
Special order items are available for out-of-state sales. Phone orders are welcome.
FAQ
- Inventory Updates: Our website inventory is updated via our distributors. Some items may be backordered, but can still be purchased.
- Consignment Firearms: Available to New York residents who can complete paperwork in person at our store. These items may include high-end brands like Nighthawks, Atlas Gunworks, Taran Tactical, and Fowler Industries.
- Special Orders: Through our network of distributors, we can source specific firearms for New York residents (subject to state compliance) or out-of-state customers.
- Consignment Sales: Want to sell your firearm? We offer consignment services and will market your item to our customers. Consignment fees vary by item.

Additional Information
- Privacy: We do not sell your information to third parties. Your privacy is our priority.
- No Firearm Returns: Firearms are non-returnable once you take possession.
- Non-Refundable Deposits: Deposits for special orders are non-refundable, as we are committed to fulfilling your order.
- Shipping Accuracy: Double-check your shipping address. We are not responsible for lost or damaged packages due to incorrect information.
Returns
Our return policy lasts 5 days from the date of purchase. After 5 days, we cannot offer refunds or exchanges. This applies to orders placed in person, over the phone, or via email.
To be eligible for a return, items must be unused, in their original condition, and in the original packaging.
Non-Returnable Items:
- Firearms
- Ammunition and perishable goods.
- Small parts, hazardous materials, or flammable liquids/gases.
- NFA items.
Firearms are shipped with tracking and insurance. If a firearm arrives damaged, claims must be handled through the shipping insurance provider.
Partial Refunds (if applicable):
- Deposits are non-refundable.
- Items not in original condition, damaged, or missing parts (not due to our error) may qualify for partial refunds.
- Returns after 5 days are not eligible.
Refund Process:
- Once we receive and inspect your return, we’ll notify you via email about approval or rejection.
- Approved refunds will be processed to your original payment method within a few days.
Late or Missing Refunds:
- Check your bank account, then contact your credit card company or bank.
- If issues persist, email us at info@empirestatemunitions.com.
Sale Items:
- Only regular-priced items are refundable. Sale items are non-refundable.
Exchanges:
- We replace defective or damaged items (non-firearm) if reported within 5 days. Email us at info@empirestatemunitions.com.
Gifts:
- For gift purchases shipped directly to you, a gift credit will be issued upon return.
- For gifts shipped to the giver, the refund will be issued to the original purchaser.
Shipping Policy
To return a product, email info@empirestatemunitions.com for instructions. You are responsible for return shipping costs, which are non-refundable. The return shipping cost will be deducted from any refund.
Delivery times vary by location. For items over $75, consider using a trackable shipping service or purchasing insurance, as we cannot guarantee receipt of returned items.
Firearm Shipping:
- All firearms must be shipped to a valid Federal Firearms Licensee (FFL) in New York or your state.
- Ammunition sales in New York must be shipped to a licensed FFL for pickup, per state law.
Empire State Munitions complies with all federal, state, and local laws restricting the sale and transfer of firearms, magazines, ammunition, and other prohibited items. It is your responsibility to know your local and state laws.
Age Restrictions (per federal law):
- Rifles, shotguns, and their ammunition: 18+.
- Handguns and their ammunition: 21+.
New York Restrictions:
- No magazines over 10 rounds.
- All firearms must comply with the NY SAFE Act (e.g., no assault weapons, as defined by the state).
- Ammunition sales require a background check and must be shipped to a licensed FFL.
Other State Restrictions:
- Alaska: No ammunition or primer shipments.
- Colorado: No magazines over 15 rounds.
- Connecticut: No magazines over 10 rounds; certain firearms restricted.
- Hawaii: No pistol magazines over 10 rounds; no ammunition or primer shipments.
- Illinois (Cook County): No firearms or magazines.
- Maryland: Handguns must be on the Maryland Approved Handgun List; no magazines over 10 rounds.
- New Jersey: No magazines over 15 rounds; certain semi-auto firearms restricted; Firearms/Ammunition ID card required for ammo purchases.
- Washington, DC: No firearms; no magazines over 10 rounds.
We do not ship to APO or PO Boxes. We select the most efficient carrier (USPS, UPS, or FedEx). Orders require credit card authorization and verification before processing.
